We’ve described everything as clearly and concisely as possible and have avoided legalese as much as possible, so that you can make sense of all this without needing a law degree.

Scene It supports and respects a person’s right to privacy and to the careful management of any personal information that Scene It is required to collect in order to provide products and services. 

We will do all that is reasonable to ensure your personal information is kept secure and up to date. However, we are unable to guarantee that your personal information will be 100% secure. 

Wherever possible we will only request personal information that is required for us to complete the related task. Your information will not be stored for longer than is necessary for the purposes described in this Privacy Policy or as required by applicable legislation. 

How and What Data do we Process? 

We only collect and process data where we have a legal basis to do so, and in compliance with the provisions of POPI and the European Union’s General Data Protection Regulation (“GDPR”). 

We may process your data in the following circumstances:

  • where we need to consult with you or perform on a services contract we are about to enter into or have entered into with you; 
  • where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; and/or

We may collect indirect information from all users of our website in order to maintain our website’s basic functionality, or to anonymously track what users do on our website, in the form of cookies. This includes IP addresses, and web browser information. 

How we use your data 

We use data collected by us, directly and indirectly, as may be necessary to operate our platform. Data is also used to ensure our website functions properly, and to optimise and improve our offering. 

Information submitted by creatives will be publicly available on the website. Creatives are responsible for the information submitted by them and acknowledge that this information will be displayed publicly. 

We may contact users directly or through a third-party service provider regarding videos for which a user has requested more information. Scene It may also contact users with offers for additional services we think you’ll find valuable if you give us consent, or where allowed based upon legitimate interests. 

The hosting, analytics, email sending and other technical provisions for our website and mobile app may be hosted on servers outside of South Africa or outside of the European Union. 

However, Scene It shall ensure that its host providers are subject to laws, or policies, which uphold principles for the reasonable processing of information substantially similar to the data protection laws applicable to the European Union and/or in South Africa to ensure adequate protection of any such data. 

We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process, to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity we consider to be illegal or unethical. 

We use analytics tools provided by service partners such as Google Analytics to collect information about how users interact with our website, including what pages you visit, what site you visited prior to visiting our website, how much time you spend on each page, what operating system and web browser you use and network and IP information. We use the information provided by these tools to improve our service offering. These tools place persistent cookies in a user’s browser to identify the user

the next time a user visits our website. Each cookie cannot be used by anyone other than the service provider (e.g. Google for Google Analytics). The information collected from the cookie may be transmitted to and stored by these service partners on servers in a country other than the country in which you reside. What Are Cookies?

IP Addresses 

IP addresses are used by your computer every time you are connected to the Internet. Your IP address is a number that is used by computers on the network to identify your computer. IP addresses are automatically collected by our web server as part of demographic and profile data known as “traffic data” so that data (such as the Web pages you request) can be sent to you.

    1. As a Visitor 

You’re a “visitor” if you browse our website but don’t submit any personal information about yourself. 

For example, if you visit this website and take a look through our content, our sales pages and knowledge base without signing up for anything, then you’re a visitor. As a visitor, the website uses several third party services that act in order to provide you with a better experience and allow us to optimise our content. 

The following third parties have limited access to some of your data:

what content to create and similar decisions all focused 

on improving the experience for our visitors. 

○ We may integrate Google Analytics with Google 

Adwords so that we can measure the performance of our

○ We may use Meta conversion tracking to understand how 

our Instagram and Facebook ads are performing. 

  • Social sharing tools 

○ Some of the content on the site includes social sharing 

widgets to quickly allow you to share content with your 

network. Some of these services gather data about you if 

you are logged in to these social networks while visiting

  1. Signing Up to Our Mailing List

On this site, we display various forms that allow you to sign up to our mailing list. When you sign up through one of our forms, we’ll commonly ask you for the following data: 

  • Name; 
  • Email address. 

We’ll also collect the following: 

  • Which form you filled out; 
  • Referrer URL (the URL that you led you to the page that you signed up through); 
  • Your IP address. 

We store this data on our site for the following reasons: 

  1. Compliance – to keep a record of where our leads came from 2. Testing – to optimise and improve the newsletter sign up forms that we display 
  2. Relevance – we try not to show a form that you’ve already signed up for 

The data that you submit is also added to a third party service called The Newsletter Plugin. This is a tool that we use to send email communications to you. 

  1. Purchasing a Product from Us 

When purchasing a product from us, we may collect the following data: 

  • First name 
  • Last name 
  • IP address 
  • Email address 
  • Billing address 
  • Shipping Address 
  • Country of residence 
  • Post code 
  • Bank details 

Any payments made on our website are processed by our partner payment gateways. Your credit card details are encrypted and stored with the payment gateway and so these details are not visible or available to Scene It or the staff of Scene It. If you have a query please contact the payment gateway directly. 

Please note that this data is captured when you submit an order on our checkout page regardless of whether you complete the purchase of the product through our payment processor.

This data is required for the following reasons: 

  1. Compliance – we have a duty to understand what country you are resident of so that we can charge the correct VAT amount. We must also keep a record of this data for tax audit purposes. 
  2. Integration with our payment processor – we collect address personal data such as your name, email and address to integrate with our payment processor (the service we use to collect payments). 
  3. Product delivery – In order to give you access to the products that you purchase and to our support team, we need to create an account using your name and email address. 

Product or Services Review 

When you provide a rating or review of a product or post, you consent to us using that rating or review as we deem fit, including without limitation on our website, in newsletters or other marketing material. Please note that your name may appear next to that rating or review. If you do not agree to this, please do not put any ratings or reviews on the website. We will not display any of your contact details with a rating or review. 

Who has access to your data 

Your personal information will be kept as secure as reasonably possible and not sold, rented, or shared with any third party other than in the execution of providing you with goods and services in line with this privacy policy. 

Your personal information will be available only to those Scene It employees, consultants or representatives that are required to provide the goods or services that you have requested. These individuals are trained in the requirements of POPI and there are signed agreements or policies in place. 


We strive to provide you with choices around marketing and advertising. You will receive marketing communications from us if you are an existing user of ours and you have not opted-out of receiving that marketing. 

While we may use your personal data within our company group, we will get your express opt-in consent before we share your personal data with any third party. 

You can ask us or authorised third parties to stop sending you marketing messages at any time by contacting us or the relevant third party at any time and requesting us to cease or change your marketing preferences.

Where you opt-out of receiving these marketing messages, this opt-out will not apply to other personal data of yours which we process for another lawful basis. 

International Transfers 

We may share your personal information within our company group and with affiliates, and this may involve transferring and processing your data outside of South Africa. 

Whenever we may transfer your personal information out of South Africa, we ensure a similar degree of protection is afforded to it by ensuring that we have a contract in place between the parties with clauses speaking specifically to data protection and the duties of each party related thereto which gives personal information the same protection it has in South Africa.

Data Security 

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used, or accessed in an unauthorised way, altered, or disclosed by using a respected hosting provider, and keeping our site updated. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a legitimate need to know. They will only process your personal information on our instructions, and they are subject to a duty of confidentiality. 

We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so. 

Data Retention 

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements (including financial/tax reporting and record-keeping laws). 

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information, any other South African applicable law requiring us to retain the data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your personal information (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you. 

Your Legal Rights 

You have rights under POPI in relation to your personal data. Please contact us to find out more about, or manifest, these rights: 

  • request access to your personal data; 
  • request correction of your personal data; 
  • request erasure of your personal data; 
  • object to the processing of your personal data; 
  • request a restriction of processing your personal data; 
  • request transfer of your personal data; and/or 
  • right to withdraw consent. 

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances. 

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. 

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
